Breaking Alabama’s Leaf Law Could Cost $3,000 Fine And Jail Time
Fall is here and the leaves start doing their thing.
I'm here to just keep you informed and save you some money in the future.
Alabama has a bunch of laws on the books regarding what you are allowed to put in the trash.
I never thought what I throw in the trash can is gonna have the police knocking my door down.
However, we have multiple laws on this topic that can get you in trouble.
By the way, Tuscaloosa County has an ordinance requiring ALL residents to have a garbage collection service.
Some folks are not aware of that little fact.
According to Alabama Code Title 45: It is illegal to dispose of yard waste in any manner except for a landfill or by a trash pick-up service.
However, that's not the law that can cost thousands of dollars plus send you to jail. You will get more details on that law below.
Now, laws vary across the state of Alabama, but yard waste includes: leaves, lawn cuttings, weeds, shrubs, and pruning.
What law can really get folks into trouble?
Well, it's the one that specifically deals with the burning of leaves.
It is ILLEGAL to burn leaves in Alabama without a permit or during a burn ban.
You need a permit from the Alabama Forestry Commission to burn more than a quarter-acre for agricultural purposes.
Burning WITHOUT a permit is a Class B misdemeanor and can result in up to six months in jail and a $3,000 fine.
There is an annual burn ban in effect from May 1-October 31 in 12 Alabama counties.
