Defense attorneys are seeking to subpoena four witnesses for a second hearing in the Jamea Harris capital murder case later this month.

In a subpoena request, Darius Miles' attorney Mary Turner asked to subpoena Cedric Johnson, Asia Humphrey Shubonte Green and Eileen Carbin to appear in court on May 24.

Miles and his long-time friend and co-defendant, Michael Davis, are being held in the Tuscaloosa County Jail on capital murder charges for their role in the death of Harris who was shot in January on The Strip in Tuscaloosa in mid-January.

During the preliminary hearing in February, the defense claimed Johnson fired the first shots during the incident, causing Davis to act in self-defense when he returned gunfire that struck Harris.

Humphrey, Harris' cousin, was in Harris' vehicle at the time of the shooting and appeared in court during the preliminary hearing in February.

Green, a friend of Johnson, was present at the Walk of Champions after the shooting took place and where Harris was pronounced dead, according to testimony from Brandon Culpepper, the Tuscaloosa Violent Crimes Unit lead investigator in the case.

Johnson was subpoenaed earlier this week to appear at the hearing, which will double to see if the defendants will receive a bond and discovery hearing to hear what evidence the prosecution intends to use for the trial.

If Johnson complies with the request, it will be the first time his testimony will be heard in public-- he did not appear in court for the previous hearing.
