Kennedy said investigators believe 20-year-old Justin Gachoya was driving under the influence when he collided with a second vehicle carrying three people. Two people in that vehicle were hurt, but the most serious injuries were suffered by Gachoya's passenger.

Kennedy said that victim suffered severe injuries and was transported to UAB Birmingham for treatment, where they are reportedly in critical but stable condition.

"Gachoya was suspected of being at fault for the crash and was suspected of being under the influence of alcohol or controlled substances by responding Northport Police," Kennedy said. "Due to these facts, the Violent Crimes Unit responded to assume the investigation, working alongside with the Northport Police Accident Reconstruction Unit. "

Kennedy said police have charged the driver with one count of first-degree assault, two counts of third-degree assault for the passengers in the second vehicle and one count of DUI.

Gachoya was placed in the Tuscaloosa County Jail, where his combined bond is set at $38,000.
