A group of residents at a Tuscaloosa apartment complex is suing after complaints of uninhabitable conditions they are facing were ignored by owners and management.

In a lawsuit complaint that was filed in the Tuscaloosa County Circuit Court Tuesday, owners Forrester Apartments, LLC., along with Dalcor Management, Inc. and Kendrick Wilson, the property managers, were named as defendants in the case.

According to the complaint, seven plaintiffs that currently live in six units at Forrester Gardens Apartments, which is located in the 1300 block of James I. Harrison, Jr. Parkway East in Tuscaloosa, said they began noticing mold, mildew, raw sewage and feces in various places throughout the units.

The complaint said the residents have been living in uninhabitable living conditions where "raw sewage has been back flowing into their apartments, instances of feces leaking from the ceiling and living with mold and mildew throughout" which they said through exposure, has caused health problems.

The complaint said the defendants were notified by the residents of the problems but "failed and refused to remedy the hazardous conditions although they have been contacted numerous times."

The plaintiffs said the owners and management "knew or should have known said premises were defective and/or unreasonably dangerous to residents and visitors" and "failed to properly train and supervise employees on keeping, repairing and/or maintaining the subject premises free and clear of dangerous conditions."

The complaint said the plaintiffs are seeking damages for negligence, including violating Alabama law regarding habitation conditions and mental and physical health anguish sustained as a result of the conditions.
